Terms of Service

1. Service
Merchcraft generates lifestyle product images and related content from photos you upload. We grant you a non-exclusive right to use the service, subject to these terms and to our Acceptable Use Policy, which is part of these terms.
2. Eligibility & account
You must be at least 18 years old and provide accurate account information. You are responsible for keeping your credentials safe and for all activity under your account. Accounts must not be shared or resold.
3. Credits & payment
Generations are paid with credits (1 credit = 1 generation of 3 variants). Credits are non-refundable, with two exceptions: when a generation fails for technical reasons, and the first time a generation is blocked by our safety filters, the credit is refunded automatically. Repeated attempts to generate content our filters refuse consume the credit. Subscriptions renew until cancelled.
4. Your content & warranties
The images and data you upload remain yours. You grant us a limited license to host and process them, and to send them to our AI providers, solely to provide the service. You warrant that you hold all rights to the product images you upload (including visible trademarks, logos and designs), that any identifiable person depicted has given consent, and that the products shown may legally be sold in your market. You are solely responsible for the products depicted and for how you use the results.
5. Generated content
Images and text you generate and download are yours to use commercially. Free-tier outputs are watermarked. AI outputs are not exclusive: similar results may be produced for other users. AI output can be inaccurate or unsuitable; review every result before publishing it. Generated images carry an industry standard invisible watermark identifying them as AI generated, as required by applicable transparency rules.
6. Acceptable use & enforcement
The Acceptable Use Policy defines prohibited and restricted content. We may refuse generations, apply account strikes, and suspend or terminate accounts that violate it or attempt to circumvent our limits or safety filters. Termination for violation is without refund of remaining credits or subscription time. We may report illegal content to the competent authorities. You can close your account at any time from Settings.
7. AI processing
Generation is performed via third-party AI providers. Your inputs are sent to these providers solely to produce your results. The providers used are listed in our Privacy Policy.
8. Indemnification
You will indemnify and hold us harmless from any claim, damage or expense (including reasonable legal fees) arising from the content you upload, the products you promote, your use of generated results, or your breach of these terms or of the Acceptable Use Policy.
9. Liability
The service is provided “as is”. To the extent permitted by law, we are not liable for indirect damages, and our total liability is capped at the amounts you paid us in the 12 months preceding the claim. Nothing in these terms excludes liability that cannot be excluded by law.
10. Governing law
These terms are governed by French law. Mandatory consumer protection rules of your country of residence remain unaffected.
11. Changes
We may update these terms. Material changes are announced in the app. Continued use after a change means you accept the updated terms.
